Introduction

These Terms of Service explain the rules that apply when families, learners, tutors, applicants, visitors, and other users access or use Birdlin's website, tutoring platform, applications, sessions, content, communications, or related services.

By creating an account, booking a class, attending a session, applying to tutor, browsing the website, or otherwise using the services, you agree to these terms. If you use the services on behalf of a child, family, company, school, or other organization, you confirm that you have authority to accept these terms for them.

Accounts and Eligibility

You agree to provide accurate, current, and complete account information and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs through your account.

Learners under 18 may use the services only with permission from a parent or legal guardian. Parents and guardians are responsible for a learner's use of the services, including attendance, behavior, payments, and communications connected to the learner's account.

We may refuse, suspend, or close an account if we believe the account information is inaccurate, the account is being misused, or continued access may create legal, safety, security, or service-quality concerns.

Tutoring Services

Birdlin provides online tutoring and learning support, including live sessions, scheduling tools, learning materials, tutor feedback, messaging, and related features. Services may vary by location, subject, grade level, tutor availability, plan, or product version.

Tutoring is designed to support learning, practice, and confidence. We do not guarantee any particular academic result, grade, test score, admission decision, certification, or outcome.

We may update, add, remove, pause, or limit features at any time. Where reasonably practical, we will provide notice for material changes that affect paid services.

Parent and Learner Responsibilities

Parents and guardians are responsible for ensuring learners attend sessions on time, have a suitable device and internet connection, and use the services in a safe, respectful, and appropriate environment.

Learners must treat tutors, staff, and other users respectfully. Harassment, threats, bullying, sexual content, hate speech, cheating, sharing another person's private information, or disrupting sessions is not allowed.

Parents and learners should not share account credentials, session links, recordings, tutor contact details, or platform content with anyone who is not authorized to use the account.

Tutor Responsibilities

Tutors must provide accurate application, identity, qualification, availability, and payment information. Tutors may be required to complete screening, onboarding, training, background checks, or ongoing verification before or during platform access.

Tutors are responsible for delivering sessions professionally, joining on time, following Birdlin policies, maintaining appropriate boundaries, protecting learner privacy, and using platform tools only for approved tutoring purposes.

Tutors may not move families or learners off-platform for services, payments, messaging, or scheduling unless Birdlin expressly authorizes it in writing.

Payments, Plans, and Cancellations

Paid services, subscription plans, packages, fees, taxes, renewal dates, cancellation rules, and refund eligibility will be shown at checkout, in account settings, or in an applicable order flow. You authorize us and our payment processors to charge the payment method you provide for amounts due.

Unless stated otherwise, subscriptions renew automatically until canceled. Canceling a subscription stops future renewals but does not automatically refund amounts already charged.

We may issue credits, make-up sessions, or refunds at our discretion or as required by law. Missed, late, canceled, or rescheduled sessions may be handled according to the cancellation policy shown for your plan or communicated by Birdlin.

Acceptable Use

You may use the services only for lawful, personal, educational, and platform-approved purposes. You may not interfere with the services, attempt to access systems or accounts without permission, reverse engineer platform technology, scrape content, bypass security controls, or use the services to build a competing product.

You may not upload, send, display, or distribute content that is unlawful, harmful, deceptive, infringing, abusive, discriminatory, sexually explicit, or otherwise inappropriate for a child-focused learning environment.

We may remove content, restrict features, suspend sessions, or terminate access if we believe a user has violated these terms or created safety, trust, legal, or operational risk.

Content and Feedback

You keep ownership of content you submit to the services, such as messages, assignments, files, notes, drawings, reviews, or feedback, subject to rights held by others. You grant Birdlin a limited license to host, store, use, display, reproduce, adapt, and share that content as needed to provide, secure, support, improve, and operate the services.

Tutors may create lesson materials, explanations, activities, notes, and similar educational content through the services. Unless a separate written agreement says otherwise, Birdlin may use tutor-created materials to provide, improve, support, and operate the tutoring services.

If you send us suggestions, ideas, or feedback, you allow us to use them without restriction or compensation to you.

Privacy and Safety

Our Privacy Policy explains how we collect, use, share, and protect personal information. By using the services, you acknowledge the Privacy Policy and agree that we may process information as described there.

We may monitor, review, record, or retain sessions, messages, support requests, usage events, or account activity for safety, quality assurance, training, dispute resolution, compliance, and service operation, where permitted by law and our policies.

If you believe a learner is unsafe, a session is inappropriate, or an account has been compromised, contact us promptly at support@birdlin.com.

Third-Party Services

The services may rely on third-party tools, platforms, processors, payment providers, video services, analytics providers, communication tools, or links. Third-party services may be subject to their own terms and privacy policies.

Birdlin is not responsible for third-party websites, services, content, or practices that we do not control. You are responsible for complying with any third-party terms that apply to your use of connected services.

Intellectual Property

Birdlin, its platform, software, designs, interfaces, logos, trademarks, content, learning materials, and technology are owned by Birdlin or its licensors and are protected by intellectual property laws.

These terms do not give you ownership of our services or permission to use our branding except as necessary to use the services normally. You may not copy, sell, license, distribute, modify, or exploit our platform or content except as expressly allowed by these terms or by written permission.

Disclaimers

The services are provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, error-free operation, or guaranteed educational outcomes.

Online tutoring depends on devices, internet connections, third-party services, and user participation. We are not responsible for interruptions, delays, loss of data, missed sessions, or degraded service caused by circumstances outside our reasonable control.

Limitation of Liability

To the fullest extent permitted by law, Birdlin and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or educational opportunities.

To the fullest extent permitted by law, our total liability for claims relating to the services will not exceed the greater of the amount you paid to Birdlin for the services giving rise to the claim during the 12 months before the claim or one hundred U.S. dollars.

Indemnification

You agree to defend, indemnify, and hold harmless Birdlin and its affiliates, officers, employees, contractors, licensors, and service providers from claims, losses, damages, liabilities, costs, and expenses arising from your use or misuse of the services, your content, your violation of these terms, your violation of law, or your violation of another person's rights.

Changes and Termination

We may update these terms from time to time. Updates are effective when posted unless a different effective date is stated. If changes are material, we may provide notice through the services, by email, or by another reasonable method.

You may stop using the services at any time. We may suspend or terminate access if you violate these terms, create risk, fail to pay amounts due, or use the services in a way that may harm learners, tutors, other users, Birdlin, or the platform.
